Service Tax on Wines in Restaurants Confirmed by HC
Aug 16: The Delhi High Court has upheld the decision of the Central government imposing service tax on food and beverages including wine served in air-conditioned restaurants and hotels across the country, making the approximate 5% service tax being charged as legally kosher. The court’s reported decision was announced last Friday on the plea of Federation of Hotels and Restaurants Association of India (FHRAI) against the levy of this tax by taking the stand that the Parliament was not competent to legislate on this aspect. Collective Punishment for violating Prohibition in Bihar
